These Terms of Service ("Terms") govern your access to and use of Psiu, operated by AXTERN LABS ("we", "our", "us"). By using Psiu, you agree to these Terms.
1. Eligibility
You must be at least 13 years old to use the App. By using Psiu, you confirm that you meet this requirement and are legally capable of entering into these Terms.
2. Description of the Service
Psiu provides AI-generated informational notifications based on prompts and schedules defined by the user. The App does not provide professional, legal, financial, or medical advice.
3. User Responsibilities
You agree not to:
- Submit unlawful, harmful, misleading, or infringing content
- Interfere with App functionality
- Use the App to harass, spam, or distribute misinformation
- Attempt to reverse-engineer or exploit the App
4. AI-Generated Content Disclaimer
Psiu uses artificial intelligence to generate content. You understand and agree that:
- AI output may be inaccurate or incomplete
- We do not guarantee factual accuracy
- You alone are responsible for how you use the information
5. Intellectual Property
All rights to the App—including software, design, and trademarks—belong to AXTERN LABS.
You retain ownership of the prompts you submit but grant us a non-exclusive, worldwide, royalty-free license to process them to operate and improve the App.
6. Third-Party Services
Psiu may rely on third-party infrastructure, AI services, and analytics. We are not responsible for their operations or outages.
7. Availability of the App
We may modify, suspend, or discontinue parts of the App at any time, without liability.
8. Termination
We may suspend or terminate your access if you violate these Terms. You may stop using the App at any time.
9. Disclaimer of Warranties
The App is provided "as is" and "as available" with no warranties of any kind, express or implied.
10. Limitation of Liability
To the fullest extent allowed by law:
- AXTERN LABS is not liable for indirect, incidental, or consequential damages
- Total liability will never exceed the amount you paid us in the previous 12 months
- Some states may limit these exclusions.
11. Indemnification
You agree to indemnify and hold AXTERN LABS harmless from claims arising from:
- Your use of the App
- Content you submit
- Your violation of these Terms
12. Governing Law
These Terms are governed by the laws of the State of California, excluding conflict-of-law rules.
13. Arbitration Agreement
Please read this section carefully — it affects your legal rights.
13.1 Agreement to Arbitrate
You and AXTERN LABS agree that any dispute, claim, or controversy arising out of or relating to:
- These Terms
- The App
- AI-generated content
- Any aspect of your relationship with us
will be resolved exclusively through binding arbitration, rather than in court.
13.2 Exceptions
Either party may bring:
- A claim in small claims court, if eligible
- Claims concerning intellectual property or misuse of the App directly in court
13.3 Class Action Waiver
YOU AND AXTERN LABS AGREE THAT ALL CLAIMS MUST BE BROUGHT INDIVIDUALLY. YOU MAY NOT BRING OR PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE ACTION.
13.4 Arbitration Rules
Arbitration will be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
13.5 Opt-Out Right
You may opt out of this arbitration agreement within 30 days of first using the App by emailing office@axternlabs.com with the subject line: Arbitration Opt-Out — Psiu
14. Limitation on Claims
Any claim against AXTERN LABS must be filed within one (1) year after the event giving rise to the claim; otherwise, the claim is permanently barred.
15. Changes to These Terms
We may update these Terms. Continued use of the App after updates means you accept the new Terms.
